1. Scope
These Terms of Service apply to the use of the SimpleDot app and all related services.

2. Service Description
SimpleDot is a micro-journaling app that allows you to create short journal entries.
2.1 Free Version (SimpleDot Free)
- Journal entries with text, photos, rating, and tags
- Calendar with month view
- Dashboard with insights
- Browse all entries (full-text search)
- Reading view
- 3 color themes
- Home screen widget
- Dark mode
- Data export (JSON + text)
- Daily reminder
2.2 Dot+ Subscription (Premium)
In addition to all features of the free version:
- Cloud sync (Google Drive / iCloud)
- App lock (biometrics preferred, system PIN as fallback)
- 3 premium color themes
- Advanced widget with "On This Day"
- Custom colors
3. Prices and Payment Terms
3.1 Prices
Dot+ is available as a monthly or yearly subscription. The current prices and available subscription options are displayed to you before purchase in the Apple App Store or Google Play Store.
3.2 Payment Processing
Payment processing and billing is handled exclusively by the Apple App Store (iOS) or Google Play Store (Android). The contractual partner for the purchase is Apple Distribution International Ltd. or Google Commerce Ltd., respectively. The terms of the respective app store apply in addition.
4. Free Trial
4.1 Scope
A free trial period may be offered for certain subscription options. The duration of the trial and the subsequent subscription price are displayed to you before purchase in the respective app store.
4.2 Automatic Renewal
After the trial period expires, the subscription automatically renews at the price displayed in the app store unless you cancel at least 24 hours before the trial period ends.
4.3 Cancellation During Trial
You can cancel at any time during the trial period. Cancellation is done via:
- iOS: Settings > Apple ID > Subscriptions
- Android: Google Play Store > Subscriptions
4.4 Note on Right of Withdrawal
When concluding a contract for a free trial with subsequent paid subscription, the 14-day withdrawal period begins at contract conclusion. After this period expires, no new right of withdrawal arises when the paid phase begins (cf. ECJ C-565/22).
5. Contract Conclusion
5.1 Free Version
The contract for use of the free version is concluded by downloading and installing the app.
5.2 Dot+ Subscription
The contract for a Dot+ subscription is concluded by confirming the purchase in the Apple App Store or Google Play Store. Before purchase, you will be shown an order summary with all essential information.
6. Term and Cancellation
6.1 Dot+ Monthly
- Term: 1 month
6.2 Dot+ Yearly
- Term: 1 year
6.3 Automatic Renewal
Subscriptions are processed through the Apple App Store or Google Play Store. Renewal is governed by the respective app store's terms. You can cancel at any time. Cancellation takes effect at the end of the current billing period.
6.4 How to Cancel
Cancellation is done through the respective app store:
- iOS: Settings > Apple ID > Subscriptions > Cancel SimpleDot
- Android: Google Play Store > Menu > Subscriptions > Cancel SimpleDot
Cancellation must be made at least 24 hours before the end of the current period.
6.5 After Cancellation
After the subscription ends:
- Existing entries remain stored locally
- Premium features are deactivated
- Cloud sync is stopped
- You can resubscribe at any time
7. Withdrawal and Refunds
7.1 Contractual Partner for Purchases
The contractual partner for Dot+ subscription purchases is exclusively Apple Distribution International Ltd. (iOS) or Google Commerce Ltd. (Android) as the respective app store operator (Merchant of Record). SimpleDot is not a party to the purchase contract and cannot process refunds.
7.2 Right of Withdrawal
The right of withdrawal for purchases of digital content is governed by the terms of the respective app store. During the purchase process, the app store obtains your explicit consent to the immediate provision of digital content. With this consent and full provision of the content, your right of withdrawal expires pursuant to § 356(5) BGB (German Civil Code).

7.4 Note on Free Trials
When concluding a contract for a free trial with subsequent paid subscription, the withdrawal period begins at contract conclusion (cf. ECJ C-565/22). Cancellation of the trial is done through the subscription management of the respective app store (see Section 4.3).
8. Digital Products
8.1 Provision
SimpleDot is provided as a digital product via the App Store or Google Play Store. The app is considered provided once it has been installed on your device.
8.2 System Requirements
- iOS: Version 17.0 or later
- Android: Version 8.0 (API Level 26) or later
8.3 Updates
We provide updates during the contract term that are necessary for the functionality, security, and compatibility of the app. Updates are provided through the respective app store.
8.4 Warranty
Statutory warranty provisions apply. In case of defects, you have the statutory warranty rights.
9. User Obligations
You agree to:
- Use the app only for personal, non-commercial purposes
- Not store illegal content
- Not manipulate, decompile, or reverse-engineer the app
- Keep your login credentials (if any) confidential
10. Limitation of Liability
10.1 Unlimited Liability
We are fully liable for damages resulting from injury to life, body, or health, as well as for damages caused intentionally or through gross negligence.
10.2 Limited Liability
In cases of slight negligence, we are only liable for breach of essential contractual obligations (cardinal obligations) and only for foreseeable, contract-typical damages.
10.3 Data Loss
We recommend regular backups of your data. We assume no liability for data loss due to improper use or device damage, to the extent permitted by law.
10.4 Third-Party Services
For third-party services (Apple, Google, cloud services), their respective terms of service apply.
11. Changes to Terms
11.1 Right to Modify
We reserve the right to modify these Terms with effect for the future where there is a justified reason, in particular due to (a) changes in legislation or case law, (b) changes in third-party services (e.g. app stores, payment providers), or (c) technical changes necessary to maintain the operation or security of the app. No additional costs will arise for you from any such change.
11.2 Notification
We will inform you of significant changes at least 30 days before they take effect via in-app notification.
11.3 Objection
In case of significant changes to your disadvantage, you have the right to terminate the contract effective at the time the change takes effect.
12. Final Provisions
12.1 Applicable Law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection regulations of your country of residence remain unaffected.
12.2 Dispute Resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
12.3 Severability Clause
Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
13. Translation
These Terms of Service are a translation of the German original. In case of discrepancies, the German version shall prevail.
